The Hazardous Substances Ordinance is expected to be updated in July 2023. The taking and evaluation of asbestos samples will become mandatory for certain buildings.

Amendment to the Ordinance on Hazardous Substances expected from 01.07.2023

The amendment concerns renovation work on buildings built before 1993. From around July 2023, it will be mandatory to have an asbestos sample taken and evaluated. No renovation work may be started before then. This change affects commercial buildings as well as private homes.

Asbestos sample to protect health

Asbestos has very good insulating and fire-retardant properties. That is why it has been used in a variety of building materials in the past. Asbestos fibres can be released and inhaled during renovation work. If asbestos fibres get into the lungs, they can cause diseases such as asbestosis, lung cancer or mesothelioma. For this reason, the production of building materials with asbestos has been banned since 1989. However, the building materials were still being used until 1993.

Responsibility for taking an asbestos sample

An asbestos sample must be taken and evaluated before any remediation work is started. The person who has initiated the remediation work is responsible. Generally, this includes the builder, building owner and tenant.

Scope of the asbestos sample

The collection of an asbestos sample is mandatory for premises affected by the remediation. Sampling is carried out by removing building materials from walls, ceilings and floors. In addition, an asbestos room air measurement can be carried out. Existing fire dampers are also subjected to testing.

In the case of an asbestos infestation, the requirements for removal and disposal according to the Ordinance on Hazardous Substances must be taken into account. Among other things, it is stipulated that affected rooms must be specially shielded. In addition, special extraction equipment is used to prevent the fine asbestos fibres from spreading. Performing specialists wear personal protective equipment.

Steps of taking and evaluating an asbestos sample

  1. On-site inspection of the premises in need of remediation and preparation of an asbestos report to the relevant authorities. After approval, the asbestos samples are taken.
  2. Testing of the asbestos samples by an accredited laboratory.
  3. Handing over the results of the asbestos samples.
  4. In the case of asbestos infestation, you will receive an estimate of the costs of asbestos removal and disposal on request.
